Which Tongan law governs land tenure, and how is land held?
The Land Act (Chapter 132 of the Laws of Tonga) is the framework statute for land tenure in Tonga. Under it — and the land provisions of the Constitution of Tonga (1875) — all land is vested in the Crown, Tongan male subjects are entitled to a town allotment and a tax allotment, and land may be leased but not sold. It is consolidated in the Laws of Tonga and published in the Tonga Government Gazette.

About Tonga legal coverage
Tonga is a common-law jurisdiction and a constitutional monarchy — the last remaining kingdom in the Pacific. Its legal order rests on the Constitution of Tonga, granted by King George Tupou I in 1875 and one of the oldest written constitutions in the Pacific, together with English common law, which the Civil Law Act applies where no local statute governs. Primary legislation is enacted by the Legislative Assembly (Fale Alea), consolidated in the Laws of Tonga, and published in the Tonga Government Gazette. The courts run from the Magistrates' Courts up through the Supreme Court, the Land Court, and the Court of Appeal, with the Crown Law Department acting as the government's principal legal adviser. Legislation is published in English and Tongan.
