About Sikkim legal coverage
Sikkim is a state of the Indian Union and follows the common-law based Indian legal system, but with a distinctive status: Article 371F of the Constitution preserves the laws in force before Sikkim's 1975 merger until they are amended or repealed, so older Sikkim Regulations coexist with modern state and central statutes. Primary state legislation is enacted by the Sikkim Legislative Assembly and published in the Sikkim Government Gazette, while central Indian Acts have been progressively extended to the state. Case law comes from the High Court of Sikkim at Gangtok — India's smallest high court, established in 1975 — and the subordinate courts. English is the language of law and administration, alongside the state's several official languages including Nepali, Bhutia, Lepcha and Limbu.
Sikkimese law is changing quickly: the new national criminal codes — the Bharatiya Nyaya Sanhita, 2023 and its companion statutes, in force from 1 July 2024 — apply in Sikkim in place of the Indian Penal Code, and the Section 10(26AAA) income-tax exemption for 'Sikkimese' individuals was broadened by the Finance Act, 2023 following a 2023 Supreme Court ruling, alongside continuing amendments to state Acts.
