Who may acquire permanent and long-term interests in real property in the Northern Mariana Islands?

Under Article XII of the Constitution of the Commonwealth of the Northern Mariana Islands, the acquisition of permanent and long-term interests in real property within the Commonwealth is restricted to persons of Northern Marianas descent (NMD), and leases to others are limited in duration. The restriction was adopted with the CNMI Constitution, which took effect on 9 January 1978.

About Northern Mariana Islands legal coverage

The Commonwealth of the Northern Mariana Islands (CNMI) is a self-governing U.S. commonwealth in political union with the United States under the 1976 Covenant (Public Law 94-241). It follows the American common-law tradition: the Constitution of the CNMI, effective 9 January 1978, is the supreme local law; primary legislation is enacted as Public Laws by the bicameral CNMI Legislature and codified in the Northern Mariana Islands Commonwealth Code; and executive regulations are promulgated through the Commonwealth Register. Local courts comprise the CNMI Supreme Court and the Superior Court, while the U.S. District Court for the Northern Mariana Islands handles federal matters, with appeals to the Ninth Circuit. Legal materials are published in English, alongside Chamorro and Carolinian as co-official languages.
