Who counts as a 'controller' under the GDPR when a Member State's official journal republishes personal data drawn from company filings?
In Case C-231/22, État belge v Autorité de protection des données, the Court of Justice (Third Chamber), judgment of 11 January 2024, held that the body operating a Member State's official journal is a 'controller' within the meaning of Article 4(7) GDPR for the personal data contained in company documents it is legally required to publish as they stand — even where it neither determines the content of those documents nor verifies it before publication.
