Q

What is the foundational governing instrument of American Samoa?

A

The Revised Constitution of American Samoa, which took effect on 1 July 1967, is the organic governing instrument of the territory. It establishes the executive branch, the bicameral Legislature (the Fono), and the judiciary, and is set out in the American Samoa Code Annotated (ASCA), the official compilation of the territory's statutes.

WHY LAWSTRONAUT

Why Lawstronaut for American Samoan legal research

American Samoan legal information is spread across the statutory code, the Legislature, executive departments, regulators, courts, and publication repositories. For humans, that means slow research. For AI systems, it's a bigger problem: fragmented source access, inconsistent formats, missing provenance, and weak citation trails.

Lawstronaut turns those sources into one structured legal data layer — source links, metadata, full text, versioning, and API/MCP access. Your product or agent retrieves the legal source directly instead of relying on generic web search or unverified model memory. Every answer carries a citation, a timestamp, and a link to the official document — the provenance that makes a legal research platform defensible to auditors and regulators.

About American Samoa legal coverage

American Samoa is an unincorporated, unorganized territory of the United States in the South Pacific. Its legal system blends US common law with Samoan custom (fa'a Samoa): customary law governs matai (chiefly) titles and communal land through the High Court's Land and Titles Division. The territory is governed by the Revised Constitution of American Samoa (1967) under authority delegated by the U.S. Secretary of the Interior; statutes are compiled in the American Samoa Code Annotated (ASCA) and administrative rules in the American Samoa Administrative Code (ASAC), enacted by the bicameral Legislature, the Fono. The judiciary comprises the High Court of American Samoa and the District Court — notably, American Samoa has no United States federal district court. Legal materials are published in English, with Samoan used alongside it in the community and legislature.

American Samoan law carries features found in few other jurisdictions and continues to evolve: American Samoans are US nationals rather than birthright citizens — a status tested in ongoing federal litigation such as Fitisemanu v. United States — while ASCA restrictions on the alienation of communal land and the developing body of matai title law shape property and identity in ways US mainland law does not. Because the code, the constitution, and Land and Titles jurisprudence are amended and refined over time, citations to outdated provisions can simply be wrong. Point-in-time data straight from the source is what keeps an American Samoa legal research answer correct today.
