About Afghanistan legal coverage
Afghanistan has a mixed legal system that combines Islamic (predominantly Hanafi) jurisprudence, statutory codification drafted in a civil-law style, and customary law. Primary legislation has historically been published in the Official Gazette (Rasmi Jarida) by the Ministry of Justice, with the National Assembly — the Wolesi Jirga (House of the People) and the Meshrano Jirga (House of Elders) — as the legislature and the Supreme Court (Stera Mahkama) at the head of the judiciary. Legal materials are published primarily in Dari (Persian) and Pashto.
Afghanistan's legal framework has undergone significant discontinuity: following the change of government in August 2021, the 2004 Constitution was suspended and much law is now issued by decree, while many pre-2021 statutes — such as the 1977 Civil Code and the 2017 Penal Code — continue to be referenced even as their status and application are subject to change.
